It appears that 38 Studios didn’t make payroll this week, but is in the process of making its late loan payment of $1.125 to the state of Rhode Island this week, confirmed a spokesperson for the state’s Economic Development Corporation.

Keith Stokes, EDC’s executive director who was involved in devising the $75 million loan the state granted 38 Studios also resigned last night. Former Gov. Donald Carcieri who was also responsible for the loan during his term in office has not responded to comments, but House Speaker Gordon Fox states “he has no regrets.” Taxpayers could end up paying over $100 million dollars to make up for the loan.

A source also told Joystiq that Curt Schilling’s company has fired all of its temps and contractors this week.

We have contacted 38 Studios for more comment, but the company has not responded to our questions.

Update: The check that was hand-delivered to the EDC has bounced because “there were insufficient funds to cover it.” The check was returned.
